On March 10, 1995, the Division provided a
response addressing your questions regarding the Golden Eagle Mine's Structural Inventory
Map.
Also in your March 7, 1995 letter, you raised a question regarding the Division's December
20, 1993 responses to the U.S. Office of Surface Mining's December 7, 1993 Ten-Day Notice
No. X-93-020-370-005 TV3. Specifically you question whether the information provided to
OSM was sufficient to have allowed for the identification of the correct distance from the
First North Main workings to your residence.
By letter dated December 20, 1993 we provided OSM with a copy of a portion of the Mine
Progress Map. Measurement of the distance from the First North Mains to your residence
using this map indicates a distance of approximately 350 feet. As you are aware, 350 feet is
the correct distance. Our previous error of measuring the distance from the First North
Main to your bunkhouse, rather than your residence, had been realized and corrected in
August 1993, prior to sending our December 20, 1993 letter to OSM. We therefore,
provided OSM correct information. A month later at his request, we provided Mitch
Rollings of OSM-AFO a copy of a July 7, 1993 letter to Mr. Tatum. This is the letter which
initially contained the mistaken distance figure of 750 feet. However, OSM-AFO was aware
that 350 feet was the correct distance as evidenced by the fact the OSM-AFO's February 4,

STATE OF COLORADO
