Nahcolite Mineral Leases, Rio Blanco County, Colorado Dear Mr. Baker: As you are aware, a review of your recently issued Permit was made concurrently with a review of the Annual Report submitted by Natural Soda, Inc. This review brought to light that the Permit definition of the Injection Interval did not adequately define the intended relationship between the Injection Zone and the Injection Interval. It was the intent of EPA to define the entire L-5 Zone as the Injection Zone. The Injection Interval which comprises the actual mining unit would be part of the Injection Zone. Although the injection of fluid for the purpose of mining occurs in the Injection Interval, the influence of this injection fluid is allowed within the entire Injection Zone. This was the purpose of exempting the entire L-5 Zone from the definition of an underground source of drinking water Enclosed is a copy of the Final Permit Modification No. 1 of EPA Area Permit No. C030358-00000, Natural Soda, Inc. Nahcolite Mineral Leases and a copy of the amended Statement of Basis. This modification is being issued with your concurrence to clarify the definition of the Injection Zone and its relationship to the Injection Interval and also corrects some minor typographical errors in Table One of the Final Permit.
