below and would modify the mine Plan in the following ways: <br />Air Quality: <br />• The proposed project area disturbance would be seeded with aBLM-approved seed mix to <br />stabilize soils and reduce the impacts of dust created from wind erosion. <br />• If dust becomes visible during any phase of the operations, the operator would be required to <br />provide dust abatement measures to the road and location. These would include water or <br />magnesium chloride, emulsified asphalt or other dust palliatives to decrease the application <br />frequency. <br />Cultural Resources: <br />[f subsurface cultural resources are unearthed during operations, activity in the vicinity of <br />the cultural resource would cease and a BLM representative notified immediately. <br />Pursuant to 43 CFR 10.4 the holder of this authorization must notify the authorized officer, <br />by telephone, with written confirmation, immediately upon the discovery of human <br />remains, funerary items, sacred objects, or objects of cultural patrimony. Further, the <br />operator must stop activities in the vicinity of the discovery and protect it for 30 days or <br />until notified to proceed by the authorized officer. <br />The operator is responsible for informing all persons associated with this project that they <br />would be subject to prosecution for knowingly disturbing Native American Indian shrines, <br />historic and prehistoric archaeology sites, or for collecting artifacts of any kind, including <br />historic items and/or arrowheads and pottery fragments from Federal lands. <br />Invasive, Non-native species: <br />The operator is required to control weeds for the life of the Plan in accordance with Montrose <br />County weed regulations and the Colorado Noxious Weed Act. The operator would be <br />required to submit a Pesticide Use Proposal to the BLM prior to actual noxious weed control <br />for approval of herbicides or mechanical controls. As a safeguard to avoid the inadvertent <br />invasion of noxious weeds, vehicle(s) that have been driven in weed-infested areas should be <br />cleaned with high pressure spray equipment before entering non-infested areas. The operator <br />and BLM staff would monitor for noxious weeds and contact the applicant regarding <br />treatment required. <br />Use of pesticides would comply with the applicable Federal and state laws. Pesticides would <br />be used only in accordance with their registered uses and within limitations imposed by the <br />Secretary of the Interior. Prior to the use of pesticides, the holder would obtain from the <br />authorized officer written approval of the applicant's plan showing the type and quantity of <br />material to be used, pest(s) to be controlled, method of application, location of storage and <br />disposal of containers, and any other information deemed necessary by the authorized officer. <br />The plan should be submitted no later than March l of any calendar year to cover the <br />proposed activities for the next growing season. Emergency use of pesticides would be <br />approved in writing by the authorized officer prior to such use. <br />
