Table A <br />Greg Lewecki and Associates submitted this Phase Il/lll bond release request (SL-02) on <br />behalf of landmark Reclamation This request was received by the Division on April 4, <br />2005 On April 11, 2005 the Division received a letter from the applicant requesting that the <br />areas excluded from the previous Phase I bond release tSL-O1) also be included for <br />evaluation in this final bond release request. The Las Animas County Board of County <br />Commissioners and the Las Animas County Planner were notified by certified mad on Aprd <br />12. 2005. Written notice of the permittee's intention to seek bond release was provided to <br />George Montoya by certified mail on Aprd 19. 2005, who is the landowner of the surface and <br />adjacent area Public noUCe was published once a week for four weeks beginning on April <br />13. 2005 The permit area is not located within any water conservancy district as determined <br />during the previous bond release SL-01 (letter received September 27, 1993) On May 18, <br />2005 the Division received documentation that included evidence of county and landowner <br />notrficahon and proof of publication of the written notice required by Rule 3.03.2(1) <br />Following receipt and review of these documents. the Division found the application <br />complete on May 27. 2005. Notification of the fling of a complete application was sent to the <br />applicant and the Office of Surface Mining (OSM). <br />In accordance with Rule 3.03 2(21. the Division scheduled an inspection on June 21, 2005 <br />Notice of the inspection was sent by certified mail to the applicant, Landmark Reclamation <br />and the landowner. The OSM was notified via personal communication (K Gorham to M <br />Rollings) on May 31.2005 The mspecUOn was conducted on June 21, 2005. No interested <br />parties. landowners. OSM inspectors, or county officals attended the inspection The results <br />of the inspection are incorporated by reference as documented in the DMG inspection report <br />for the Rimrock Mme dated June 21.2005 <br />OBSERVATIONS AND FINDINGS <br />Based on the Dwision s field inspection and review of the application and supporting <br />documentation, the Division believes that the Rimrock Mine has been successfully reclaimed <br />in accordance with the approved reclamation plan. <br />PROCEDURES AND SUMMARY OF THE REVIEW <br />PROCESS <br />
