Based on the data presented, the applicant has demonstrated that the site has achieved the <br />approved revegetation success criteria of 4.15.8 and the approved permit These criteria were <br />also met during at least the last two years of the extended liability period of Rule 4 15.7(5) The <br />Division also finds that the 12.62 acres of revegetation and permanent features have been <br />restored in a timely manner to conddions that are capable of supporting the pre-mine uses as <br />required by Rule 4 16.1 for the post-mining land use of rangeland <br />SUMMARY <br />Review of the data presented and final field inspection support the contention of the <br />applicant that the reclamation work completed ~s ~n accordance with the approved plan <br />Based on the observations and findings as detailed above. the Division proposes to approve <br />Landmark Reclamation's request for a Phase I bond release for 1 4 acres and a Phase Il/lll <br />bond release (SL-02) for 12.62 acres that constitute the entire disturbance at the site The <br />current reclamation liability amount is 531,000.00 Should this bond release request of <br />531,000,00 be approved. no reclamation liability will remain. The cost estimate for the <br />reclamation liability will be reduced to zero dollars and the Division will terminate ~unsdiction <br />at the site. <br />Public notice of this proposed decision will be published once a week for two weeks in the <br />Chronicle-News as soon as possible Any person with a valid legal interest. which might be <br />adversely affected by this proposed decision, may request a formal public hearing before the <br />Mined Land Reclamation Board m accordance with Rule 3.03.2(6) Requests for public <br />hearing must be submitted to the Division m writing within thirty (30) days of the first <br />publication of the public notice If no hearing is requested. the Division's decision will <br />become final <br />
