Upon further <br />review of your Request for Transcript, I realized that you are requesting a transcript of the Line <br />Camp Pit Pre-hearing Conference, not of the Snal Board hearing on the permit application. <br />I reviewed your request with the Board's attorney and was informed that pre-hearing conferences are <br />not adjudicatory proceedings, as described in the State Administrative Procedure Act, Section <br />24-4-105, C.RS. As such, no electronic recording of the meeting was required to be made pursuant <br />to the provisions of Section 24-4-105(13), C.R.S. <br />It is my understanding, however, that Wally Erickson of the Division made a partial tape recording <br />of the Line Camp Pre-hearing Conference for his own use in assisting with the preparation of the <br />Pre-hearing Order in that matter. Mr. Erickson's tape recording only captured part of the meeting, <br />due to a problem with the tape recorder. <br />Therefore, I am forwarding your request to Mr. Erickson in our Durango Office, 701 Camino De] <br />Rio, Room 125, Durango, Colorado 51301; 970.247.5469.
