• 2. The Division does not propose to approve a ford of an intermittent, a <br />perennial or an ephemeral stream which drains at least one (1) square <br />mile. Fords will be allowed across ephemeral streams with a watershed <br />less than one (1) square mile. The Division finds that the fords will not <br />affect stream sedimentation or fish, wildlife, and related values due to <br />light and infrequent use. <br />3. The light-use roads are pre-existing roads and will be retained after <br />reclamation of the Bowie No. 2 Mine site. <br />II. Support Facilities -Rule 4.04 <br />A. Construction of support facilities will not result in change, destruction or <br />disruption of oil, gas pipelines or water wells, nor will coal slurry pipelines or <br />railroads be impacted. Therefore, the Division approved those activities (4.04(6)). <br />A list of approved facilities may be found in Section 2.05.3(3) of the permit. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />• 1. The Division granted approval for small area exemptions from the use of <br />sediment ponds, due to the limited size of the azeas and due to the fact that <br />ponds and treatment facilities are not necessary for the drainage to meet <br />the effluent limitations of Rule 4.05.2 and applicable State and Federal <br />water quality standards for receiving streams, and also due to the fact that <br />no mixing of surface drainage with a discharge form underground <br />workings will occur. The locations of the small areas to be exempted are <br />discussed on Page 2.05-32 of the permit application and are shown on <br />permit document Map 21-1 and Map 95266-02 (4.05.2(3)(b)(i)). <br />Storm runoff from six small azeas at the mine site are subjected to <br />alternate treatment prior to leaving the permit area. The six areas are 1.) <br />the "material storage area below Pond C, 2.) the pump station, 3.) the <br />topsoil stockpile near the Gob pile, 4.) the cover stockpile near the Gob <br />pile, 5.) the mine entrance area and 6.) the Freeman Gulch vent fan site. In <br />addition, altemate sediment control measures are employed at several <br />methane de-gas drill pads. <br />2. The Division granted an exemption from use of sediment ponds for <br />drainage frotn underground mine workings as long as no mixing with <br />surface drainage will occur and as long as ponds and treatment facilities <br />are not necessary for the drainage to meet effluent limitations of Rule <br />4.05.2 and applicable Slate and Federal water quality standards for <br />receiving streams (4.05.2(3)(b)(ii)). <br />23 <br />
