I <br /> <br />WHEREAS, the parties to this Agreement, GEC minerals, Inc., <br />and Harrison-Peltron desire to enter into the basic agreement <br />attached hereto, but certain changes are necessary to said Agreement. <br />It is agreed that the following amendments to the basic Agreement <br />shall be considered as part and parcel of the original terms. <br />Harrison-Peltron shall maintain any and all Workmen's <br />Compensation Insurance coverage as required by Colorado Statutes <br />for its employees who perform Labor on the subject project. <br />Harrison-Peltron shall hold GEC minerals, Inc., harmless from any <br />claims of whatever nature made by the employees of Harrison- <br />Peltron against GEC Minerals, with the exception of any claims <br />resulting from the negligence of GEC Pinerals, Inc., whether for <br />Workmen's Compensation related claims or other claims of what- <br />ever nature. <br />Should Harrison-Peltron exercise its right under the basic <br />Agreement to construct temporary haul roads in the area where <br />the "gob" will be disposed to facilitate access and placement <br />of "gob" material in the pits, then it shall have the obligation <br />of making full reclamation of said lands used for the roadways <br />in conformity with requirements of the State of Colorado. <br />AGREED TO AND ACCEPTED <br />G.E.C.
