(E:FNI) does <br />not agree that the Sunday Mine is a Designated Mining operation <br />(DMO). EFNI disputes the designation for the following reasons: <br />i. The Sunday Mine operation does not meet the criteria for <br />designation provided in Rule 1 of the Mineral F:ules and <br />Regulations of the Colorado Mined Land Reclamation 1BOard, as <br />amended in April, 1994 (Rule 1). <br />2. The criterion given in the letter, which was applied to <br />determine that the Sunday Mine would be a DMO, is rn~t one of <br />those listed in Rule 1. <br />3. Reclamation activities carried out concurrent with mining <br />operations, and stormwater management measures ensure that no <br />toxic or acid-forming materials are exposed or disturbed in <br />quantities sufficient to' adversely affect human health, <br />property, or the environment. <br />
