PROPOSED DECISION <br />Bused on the observations above, the Division proposes to approve P&M's request for Phase <br />II and III bond release for the East Ridge, Center Ridge and South-of-Shop Areas of the Edna <br />Mine. This proposed decision will release the applicant from liability for. The specific areas <br />are located within the following legal description: <br />East Ridge - 37.5 acres <br />E''/z NE'/a, Section 13, T4N, R85W <br />SW'/a NW'/a, Section 18, T4N, R 85W <br />Center Ridge - 15.6 acres <br />W '/z NE'la, Section 24, T4N, R86W <br />NW'/a SE'/a, Section 24, T4N, R86W <br />South-of -Shop - 10.5 acres <br />W'/z NW'/a, Section 19, T4N, RSSW <br />NE'/a NW'/a, Section 19, T4N, R85W <br />Total reclamation cost estimates for these areas were $110,619.00. A bond release was approved in <br />1984 for reclamation conducted in the Center and East Ridge aeeas. The amount of bond released <br />was $3b,060.00 for Phase I and II reclamation in portions of these areas. The Division proposes <br />to release the remaining $24,039 of the reclamation costs for Center and East Ridge plus the <br />$50,000.00 for reclamation of the South of Shop Slide area. The total amount proposed for release <br />in SL-07 is $74,559.00. There is no remaining reclamation work which remains to be done in the <br />proposed release aeeas. <br />The Division holds a reclamation bond in the amount of $5,042,176.00 for al] the lands within the <br />Edna Mine permit boundary. With the proposed bond release, the required amount of bond will be <br />$4,967,617.00. This amount will be retained for the remainder of all permitted aeeas at the Edna <br />Mine. <br />Any person with a valid, legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Boazd in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Steamboat <br />Pilot as soon as possible. Requests for public hearing must be submitted to the Division in writing <br />within thirty days of the first publication.
