<br />According to Exhibit 4.4-2, Reclamation History, topsoil was replaced on the area. Seeding <br />occurred in 1981. P&M is requesting a Phase II and III release for this area. <br />The South-of--Shop area was mined and initially reclaimed in 1978. Partial bond release had <br />been granted for the area in 1984. Some money was held for a gully repair. Shortly after the <br />bond release was approved, there was a landslide in the area. The Mined Land Reclamation <br />Board required P&M Coal Company to remediate the damage. After conducting a <br />geotechnical evaluation of the landslide, it was decided P&M would reclaim the upper scarp <br />azea. Remedial activities included topsoil salvage along the uppermost scarp, regrading of <br />the uppermost scarp to a stable slope, redistributing the salvaged topsoil on the regraded <br />slope and reseeding. These activities were considered acceptable as long as no further <br />instability on the slide mass was observed. As part of the remediation P&M was also <br />required to post $50,520 additional bond for the 10.5 acres where remediation was required. <br />P&M completed the remediation work in 1988. <br />P&M received a permanent program petnut, issued by the State of Colorado, on October 29, <br />1981. The East Ridge, Center Ridge and South of Shop areas were included in the <br />permanent program permit. In 1983, P&M submitted a bond release application for those <br />aeeas covered by the life-of--mine bond posted with the life-of-mine permit. The three areas <br />included in SL-5 were included in the life-of-mine area and were evaluated for backfilling <br />and grading. However, because the pazcels described in this bond release application were <br />seeded during the interim period, the reclamation costs were included in P&M's .permanent <br />program permit. A ten-yeaz liability period was required for these pazcels. <br />P&M Coal Company included reclamation costs in their permanent program bond for these <br />aeeas. In Center Ridge $47,352 was estimated for the final grading and seeding costs. In <br />East Ridge $12,747 was included for seeding. No reclamation costs were included for <br />topsoiling. The South-of-Shop remediation costs were estimated to be $50,520. A bond <br />release application was approved in April, 1984 which released $36,060.00 for reclamation <br />in portions of the Center and East Ridge areas. P&M is requesting a total of release of <br />$74,559.00 in this bond release request. <br />P&M applied for the bond release on October 19, 1998. The application was deemed <br />complete on Mazch 2, 1999 after the Division received. proof of publication of the applicant's <br />public notice. P&M published notice of the bond release application for four consecutive <br />weeks in the Steamboat Pilot from October 28, 1998 through November 18, 1998. P&M also <br />notified various government agencies and the land owners within and adjacent to the release <br />azea of the bond release application as required by Section 3.03.2(1). No written objections <br />or requests for an informal conference regarding the bond release application were received <br />by the Division. <br />The Division scheduled and conducted a bond release inspection on July 21, 1999. The site <br />inspection was conducted in accordance with Rule 3.03.2(2). Landowners of the release area <br />and the Office of Surface Mining were notified of the inspection.
