As you know by Toa's letter of February 25, <br />1986, the psrwit for wining expired on February 4, 1976. Aa I <br />wentioned end wa have provided in the 'file, the property is <br />perwitted end bonded by the State Mined Land Rsclawatlon <br />Division. Therefore all concerns regarding reclaaetion will be <br />taken care of by the MLRD bond. <br />At our meeting we diacusaed ways to abbreviate the process and <br />gat the property perwitied siwilar to the way it originally wan. <br />In Toa'a latter it appears that mining has taken place on this <br />property since or before 1961. This weans that the wining has <br />occurred bafora Adeaa County had a zoning resolution. Since <br />wining at the Tower Pit hew a continued since at least 1961, thin <br />parcel qualifies as s legal non-conforsing use. By classifying <br />it as a legal non-conforwing uaa, it will be identified in the <br />County files end would wave ell concerned a groat deal of tine <br />and effort. With this atatua, Ready Nix Concrete would have to <br />lava with the regulations For non-conforwing uses in Adaws County <br />which include not discontinuing the operation for sore than six <br />sonths and reapplying to the County if the psrwit boundary is to <br />be expanded. <br />We suggest that the legal non-conforaing uaa concept is ^ way to <br />take care of thla houaakeeping situation and give the parcel a <br />legal atatua.
