~ S • <br /> <br />Upon submittal of the after-the-fact Department of the :army <br />permit application to retain the stockpile and to discharge <br />additional fill material during reclamation, please be sure to <br />include the following information. <br />11 The volume and type of Yill material, in cubic yards, to be <br />placed within the pit for reclamation purposes. <br />21 The area of wetlands which were, and would be, impacted b}- <br />excavation of the entire pit. <br />31 1'he volume of material currently stockpiled in wetlands and <br />the area of wetlands which were adversel}~ impacted. <br />4) The average annual volume of consumptive water use, in acre- <br />feet. <br />5) A detailed reclamation plan and schedule which accounts for <br />the adverse impact to wetlands. <br />61 A plan view and cross-sections of the completed pit and the <br />proposed reclamation areas on 8 1/2" X 11" paper. 1'ou should <br />also include a location map. These drawings must be black and <br />white and in reproducible quality. <br />Please be aware that our cease-and-desist order dated August <br />17, 1988 remains in full force and effect. Further discharges of <br />fill material into "waters of the United States" will be viewed <br />as a knowing and flagrant violation of Section 404 of the Clean <br />Water Act. The Clean Water Act provides for substantial civil <br />penalties for knowing and flagrant violations of Section 409. <br />You should submit the after-the-fact Department of the Army <br />permit application to our Grand Junction Regulatory office b>• <br />November 18, 1988.
