Pace 300 <br />Section 5.02.3 <br />5.02.3 Right of Entry <br />122(5) (1) Each permittee shall conspicuously ~ai~tain at eaci <br />entrance to the surface coal mining and reclamation operations a <br />clearly visible Sion ~dnich sets forth the name, business address <br />and telephone nu,.^ber of the pennittee and the permit number of file <br />surface coal mining and reclamation operations. <br />117(5) (2) Any authorized representative of the Division, upon <br />122(4)(a) presentation of appropriate credentials, shall have the power to <br />enter at reasonable times, without delay, upon or through any <br />surface coal mining and reclamation operations or any coal <br />exploration operations and to have access to and copy any record, <br />wherever located, and to inspect any monitoring equipment or <br />method of exploration or operation, required under the Act, these <br />Rules or any permit or exploration approval. A search warrant <br />shall not be required for such purposes. <br />5.02.4 Availability of Records <br />122(8) (1) Copies of all records, reports, inspection materials, <br />or information obtained under these Rules by the Division or <br />B0a7`u', except information ldentificd d5 CpriTiGentidi, Shaii b2 <br />im;nediately available to the public at the Division office and at <br />a convenient place in the area of the mining to which the <br />information pertains. <br />(2) In order to pro tact preparation for hearinos and <br />enforcement proceedings, the Director of OSi4 and the Division and <br />Board may enter into agreements regarding procedures for the <br />special handling of investigative and enforce~ent reports and <br />other attorney work-product ,.^ateriais. <br />5.02.5 Inspections Based L'pon Citizen's Requests <br />122(7) (1) Any person who is or may be adversely affected by a <br />particular surface coal mining operation or coal exploration may <br />request the Division to conduct an inspection for violations. <br />(a) The Division shall conduct the inspection if the <br />citizen request is a sinned written request or an oral request <br />followed by a sinned written request, which gives the Division <br />sufficient basis to believe that a violation of the Act, these <br />Rules, or any permit or exploration approval has occurred. <br />believe" if: <br />(b) The Division will have "sufficient basis to <br />(i) The request alleges facts that, if true, <br />would constitute any of the above-described violations; and <br />
