Box 266 <br />Nucla, Colorado 81424 <br />RE: Letters of November 12, 7988 about blasting at Peabody Coal Company's <br />Nucla Mine. Permit C-81-008 <br />Dear Mrs, Naff: <br />The Division has received your letters (2) of November 12, 1988 regarding <br />blasting vibration, noise and dust from the 5W pit (mine area 1) at the Nucla <br />Strip Mine. As a result of your letters and in compliance with Rule 5.02,5 of <br />the Regulations for Coal Mining, we will be conducting an inspection of the <br />mine and their blasting records on Wednesday, December 7, 1988 at 8:00 A.M. <br />As stated in Rule 5,02.5(2), you may want your identity to remain confidential <br />and, if so, the Division is required to maintain this confidentiality. <br />However, according to Rule 5.02.5(3), you are also allowed to accompany <br />Division representatives on the inspection as long as you "remain in the <br />presence of and under the control, direction, and supervision of the <br />[Division's] authorized representative, and agree to comply with all <br />applicable State and Federal safety rules and regulations during the <br />inspection." This means that you will have to supply your own steel toed <br />safety shoes or boots. The Division can arrange for you to borrow a hard hat <br />and safety glasses during the inspection. You will also be required to <br />undergo a brief (30 minute) safety course at the mine site to receive a safety <br />certification prior to the inspection. I have enclosed a copy of Rule 5.02.5 <br />for your use. <br />Please let me know as soon as possible whether you wish to accompany the <br />Division's inspectors on the upcoming inspection.
