Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (DBMS) is in receipt of your complaint letter dated July <br />26, 2007. The DBMS is also in receipt ofyour complaint letters dated July l6, l9, 2Q and 23, 2007. The <br />most recent letter seems to supersede and summarize the previous letters; however, we will address all <br />pending issues with this response. <br />Your letter of July 26, 2007 states ".....based on your reluctance to handle this matter outside of the <br />official channels, I submit the following as a formal citizen complaint". Please be advised that all matters <br />brought to our attention are considered official matters, and all matters are (and have been) handled as such <br />Based upon the information available to the DBMS at this time, Basin Resources, Inc. is the valid permitee <br />for the Golden Eagle Mine, and all permittee and owner/controller information is correctly itemized in the <br />approved permit. <br />Basin Resources, Inc. (the applicant) has provided the required evidence of insurance coverage (certificate <br />enclosed). <br />All records pertaining to DBMS actions dating back to program approval are available for public review at <br />the DBMS office. <br />All matters related to the Mined Land Reclamation Board Hearing of May 16, 2007 are a matter of public <br />record. <br />The DBMS will not issue a "Failure to Abate Cessation Order" pursuant to Notice of Violation CV-2007- <br />001 because the violation was abated. <br />Please contact us if you need any further information. <br />Sincerely, <br /><~~~~~ - <br />David Berry <br />Interim Director.
