The permit contains a description and cross sections of proposed backfilling and grading <br />plans for the mine portal bench area, haul road and central facili[ies area, which is <br />predicated upon significant expansion of the existing disturbance area, currently (March <br />1998) limited to an access road and portal bench which have disturbed only 5.6 acres. In <br />the August 1995 mid-term permit review, the Division identified concerns with regard to <br />the backfilling and grading plan for the proposed portal expansion, primarily relating to <br />the apparent retention of a highwall remnant under the proposed reclamation plan for the <br />portal azea expansion. The Division also expressed concern that there was no specific <br />reclamation plan for the existing portal bench and access road. <br />Subsequently, in Technical Revision No. 11 (TR-11), the applicant submitted an <br />amended reclamation plan for the existing disturbance area, including appropriate <br />topographic maps, cross-sections, and stability analyses, indicating that the existing road <br />and mine bench would be reclaimed in accordance with applicable requirements. The <br />upper segment of the access road will be reclaimed in accordance with Rule 4.03.2(7), <br />with the lower segment retained for the postmining land use. The portal bench azea will <br />be reclaimed to a stable configuration which would approximate original contours, with <br />highwalls and depressions eliminated. <br />The reclamation plan for the existing disturbance azea is presented in Section 3.9 of the <br />permit application, beginning on page 3-22 of Volume I, extending through page 3-35. <br />Reclamation costs were estimated and reclamation bond adequacy is based on the <br />amended reclamation plan for the existing disturbance as described in Section 3.9. <br />Stipulation 23, which was attached to the Division's approval decision for TR-11, <br />requires approval of appropriate revision of the mining and reclamation plan prior to <br />initiation of any additional disturbance, or resumption of active status for purposes other <br />than reclamation. <br />Stinulation No. 23 <br />THE AMENDED RECLAMATION PLAN AND THE ASSOCIATED <br />RECLAMATION COST ESTIMATE AS REVISED PURSUANT TO TECHNICAL <br />REVISION N0. 11 ADDRESSES RECLAMATION OF THE DISTURBANCE <br />EXISTING AT THE MINE SITE ON THE DATE OF DECISION ISSUANCE <br />(MARCH 12, 1997). THE PERMIT WILL BE APPROPRIATELY REVISED, AND <br />THE RECLAMATION BOND INCREASED AS NECESSARY, PRIOR TO ANY <br />FURTHER DISTURBANCE, MODIFICATION OF EXISTING FACILITIES, OR <br />RESUMPTION OF ACTIVE STATUS FOR PURPOSES OTHER THAN <br />RECLAIv1ATION. A REVISED BACKFILLING AND GRADING PLAN WHICH <br />WILL COMPLY WITH ALL REQUIREMENTS OF RULE 4.14 WILL BE <br />SUBMITTED TO AND APPROVED BY THE DIVISION PRIOR TO ANY <br />EXPANSION OF THE EXISTING PORTAL BENCH DISTURBANCE. <br />a-t <br />
