Section 25-8-501(1) of the Water <br />Quality Conrol Act requ'ir'es that a pemrit be obtained for discharges into state waters. An inspection by the <br />Division of Minerals and Geology on June 17, 1994 has revealed that a discharge permit is necessary. <br />Therefore, the Division is requesting that the attached pemlit application be completed and submitted within <br />sildy days of receipt of this letter as required in Part 6.5.1(1) of the Regulations for the Discharge Permit <br />System. Failure to apply for and obtain coverage under the necessary pernit(s) tnay result in enforcement <br />action by this Division. Such enforcement action carries a civil penalty of up to 510,000 per day. <br />Should you feel that a permit is not required, please submit your e7~lanalion to support Ulis determination <br />along with the completed application.
