Banta. <br />Division Director <br />Re: Inspection of April 24, 1990, Load-out Sediment Pond, Orchard Valley <br />Mine, C-81-03B <br />Dear Mr. Johnson: <br />I felt it would be beneficial to both of us if I outlined, in writing, my <br />understanding of your obligations with regard to the Load-out Sediment Pond. <br />By May 15, 1990, COVCC will provide documentation that the title, legal <br />description and survey of the permit area coincide. This will include some <br />verification that the highway R.O.W. is measured from the center of the <br />highway. A survey will be performed to ensure that the pond, particularly the <br />embankment and northeastern edge of the pond fall within the permit area <br />boundary. Permit boundary information will be modified if necessary, on <br />Map 8-3, and submitted to the Division as a Minor Revision. Lastly COVCC will <br />move the permit boundary signs on the north side of the load-out to accurately <br />reflect the permit boundary. <br />Thank you for your support last week in trying to resolve this issue <br />expediently. <br />Sincerely, <br />Catherine W.
