We wish to take this
opportunity to respond.
The Division is scheduled to complete the Section 24/Hastings Mine Bid Document by
April 2, 1993. Time required for review of the document by the Colorado Division of
Purchasing, public announcement of the pre-bid meeting, the bid opening and receipt of
insurance and bonds is typically six to ten weeks. Thus, reclamation in Section 24 and of
the Hastings Mine will probably commence during the latter half of May 1993.
We have been informed that additional Federal funding for mine sites with bankrupt
sureties will not become available before the end of the Federal fiscal year
(September 30, 1993), and may not be available at all. The Inactive Mined Land (IML)
Program is therefore reluctant to initiate a Bid Document for the East Pit until the full
amount of funding available for the project is known, but has agreed to schedule the
project for the winter of 1993-1994. This scheduling anticipates that no additional funds
will be forthcoming with which to reclaim the East Pit and Chen's Hill. Should
additional funds become available, the Bid Document will be modified at that time.
Scrutinizing of the October 19, 1992, "Investigation of Section 24 Reclamation Liability,"
the 7.5 minute USGS Rockvale Quadrangle and the Colorado Geological Survey's
"Colorado Front Range Inactive Coal Mine Data and Subsidence Information, Fremont
County" reveals a discrepancy between the October 19, 1992, memo and the location of
the Double Dick and the Pioneer Canyon No. 2. Thank you for bringing this to our
attention. Page 4 of "Investigation..." incorrectly indicates that the waste dumped in the
