Public Notice <br />MCC published notice of the bond release application in the Delta County Independent once weekly <br />for four consecutive weeks, beginning on August 18, 2004. MCC also notified the landowners <br />within and adjacent to the mine permit area, and other interested parties of the application for bond <br />release, as required by Section 3.03.2(1). <br />Bond Release Inspection <br />The Division conducted a bond release inspection on October 7, 2004. The site inspection was <br />conducted in accordance with Section 3.03.2(2). Jim Burnell and Sandy Brown represented the <br />Division. Henry Bazbe represented MCC. Dennie Wilson, manager of the Lazy H Ranch, <br />represented a landowner in the bond release azea, DLH Trust - Lazy H Ranch. Mitch Rollings <br />represented the Office of Surface Mining. The Division notified the U.S. Forest Service of the <br />inspection, but' they did not attend. Inspection reports prepazed by the Division and the Office of <br />Surface Mining aze on file at the Denver office of the Division of Minerals and Geology. <br />Chronoloay of Division's Review of Bond Release Application <br />The Division reviewed technical aspects of MCC's bond release submittal in order to determine if <br />the requested bond release is warranted. The review included an evaluation of hydrologic impacts. <br />The Division requested additional information from MCC regazding slope stability, erosion control, <br />and certification of engineering drawings (letter dated October 25, 2004). MCC resolved these <br />issues in materials submitted on July 21, 2005 in the application for Minor Revision 312. <br />The Division received no written objections, or requests for an informal conference regarding the <br />bond release application. <br />Upon request from the Division, the operator revised the dollaz amount of the bond release request <br />in a phone call on October 13, 2005 from the original amount of $45,937 to $122,629. This change <br />was necessary to correct an inadvertent transposition of request amounts between SL-02 and SL-01. <br />III. CRITERIA FOR BOND RELEASE <br />The bond release application is for phase I release. Phase I release is allowed by Section 3.03.1(2)(a) <br />which states, "Up to sixty percent of the applicable bond amount shall be released when the <br />permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." <br />The reclamation plan for the bond release azea is set forth in Section 2.05.4 ofthe permit application. <br />The plan calls for removal of structures, backfilling and sealing of the two portals, regrading of <br />disturbed areas, topsoil replacement, and revegetation of disturbed areas with an approved seed mix. <br />3 <br />
