<br />Stipulation No. 14 <br /> <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER CIRUELA CANYON AND APACHE <br />CANYON DRAINAGES, THE PERMITTEE MUST COLLECT DATA ON THE QUANTITY OF <br />WATER FLOWING IN THESE DRAINAGES. MONITORING MUST BE SUFFICIENT TO <br />DIFFERENTIATE SEASONAL FLOW VARIATIONS. <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER PETE CANYON, THE <br />PERMITTEE SHALL PROVIDE A DESCRIPTION OF STREAM FLOW CHARACTERISTICS <br />AND WATER USE IN PETE CANYON. <br />THE PERMITTEE SHALL PROVIDE AN ASSESSMENT OF THE PROBABLE <br />HYDROLOGIC CONSEQUENCES OF SECONDARY OR RETREAT MINING ON THE <br />QUANTITYAND QUALITY OF SURFACE WATER IN CIRUELA, APACHE AND PETE <br />CANYONS. <br />ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATIONIS APPROVED BY <br />THE DIVISIONIN WRITING. <br />The New Elk mine is closed with regard to undermining; therefore, no advance or retreat <br />mining will occur under Ciruela, Pete, or Apache Canyons. This renewal finding serves as <br />written approval to cease any water monitoring of these areas beyond what is currently <br />required by the approved hydrologic monitoring program. Stipulation No. 14 is terminated. <br />Stipulation No. 75 <br />THE PERM/TTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC MONITOR/NG REPORT FOR <br />THE NEW ELK MINE. THE MONITORING REPORT SHALL INCLUDEA SUMMARYAND <br />ANALYSIS OF DATA COLLECTED DURING THE YEAR, INCLUDING: 11 WATER USED /N <br />THE MlN/NG OPERATION,• 2) M/NE WATER DISCHARGES TO RECEIVING STREAMS <br />(QUANTITYAND QUAL/TYI; 3/ M/NE WATER INFLOWS (ANNUAL M/NE INFLOW STUDYI; <br />41 STREAM FLOWS AND QUALITY,• 51 IMPACTS TO THE QUALITYAND QUANTITY OF <br />ALLUVIAL AND BEDROCKAQUIFERS; AND 61 IMPACTS TO SPRING FLOWS AND <br />QUALITY. THE MONITORING REPORT SHOULD INCLUDEA DESCRIPTION OF <br />MlTIGATIVEMEASURES TAKEN TO M/N/M/ZEDISTURBANCE TO THEPREVA/L/NG <br />HYDROLOGIC BALANCE. <br />The requirements of Stipulation No. 15 are included in the approved permit text and do <br />not need to be specifically stipulated as part of this renewal approval. Therefore, <br />Stipulation No. 15 is terminated. <br />Two additional stipulations have been issued since the mid-term review as a result of <br />revision to the permit.
