Submittal of Bond Release Application and <br />Comaleteness Deterwination by the Division <br />The Division received bond release application SL-5 on January 26, 2004, and found the application <br />complete on August 18, 2004, a$er the Division received proof of publication of the applicant's <br />public notice. The completeness determination was made in accordance with Section 3.03.2(1)(d). <br />Kaiser submitted the bond release application following the procedures described in the Act and the <br />Regulations. The application also utilizes the Division's Guideline Regarding Selected Coal Mine <br />Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />Kaiser published notice of the bond release application in the Pagasa Springs Sun once weekly for <br />four consecutive weeks, beginning on July 8, 2004. Kaiser also notified landowners within and <br />adjacent to the mine permit area, and other interested parties of the bond release application, as <br />required by Section 3.03.2(1). <br />Bond Release Inspection <br />The Division conducted a bond release inspection on the site on September 28, 2004. It was <br />'necessary to hold the inspection on this date, rather than an eazlier date, in order to accommodate <br />the operator's representative. The Division sent notifications of the inspection to property <br />owners within and contiguous to the site, and to the Office of Surface Mining. The,Division's <br />bond release inspection report is on file at its Denver office. The site inspection was conducted in <br />accordance with Section 3.03.2(2). Tom Kaldenbach of the Division conducted the inspection. <br />The following people attended the inspection: Mike Keegan of Kaiser Resources, Ina (the mine <br />operator), Jerry Koblitz of Greystone Environmental Consultants, Inc. (the mine operator's <br />consultant), Albert Lucero (the mine operator's earthwork contractor), Mel Martinez (the owner <br />of most of the land in the bond release azea), Amos Martinez (Mel Martinez's son), Bill Zimsky <br />(Mel Martinez's attorney), Glenn Raby of the U.S. Forest Service, and Mitch Rollings of the <br />Office of Surface Mining. <br />
