A plan must be submitted to the regulatory authority within 70 days of <br />approval of this mine plan for the handling and disposal of material in the <br />"storage area" and a post-mining topographic map of the railroad storage and <br />load-out areas. <br />11. A state air quality permit Ss required before construction and operation <br />can begin. <br />12. The applicanC will incorporate overburden analytical data submitted to <br />the regulatory authority on May 29, 1981, Into the mine plan within 30 days of <br />approval of the permit. <br />13. Prior to issuance of a permit to conduct mining operations,. the applicant <br />must: <br />(a) submit a performance bond payable to the State and the U.S. Government in <br />an amount consistent with the requirements of (b) below and the reclamation <br />cost estimates contained in the application. <br />(b) submit a map showing each area of land on the proposed permit area for <br />which a performance bond will be submitted, submit a descriptlon of activities <br />to occur on those areas of land, and identify the amount of performance bond <br />to cover reclamation costs associated with each area of land. ~~ <br />14. Company has not submitted adequate information on mule deer and antelope <br />migration problems through the area of disturbance. In order to develop <br />proper mitigation plans for the protection of the migration routes briefly <br />identified in BLM's Final EIS on the Moon Lake project, the following stipula- <br />tion has been developed. Upon acceptance of Departmental action to approve <br />the mining plan, the operator must submit to the regulatory authority the com- <br />plete study results for mule deer and antelope migration considerations within <br />30 days of approval. The regulatory authority in consultation with state and <br />federal game management agencies will determine adequate mitigation <br />procedures. <br />15. Due to poor weather conditions the applicant's survey for sage grouse lek <br />' activities y+gr~ unsuccessful. A survey is being conducted in spring of 1981 <br />to determine if any leks do occur in the area to be disturbed. Therefore, <br />before any evaluation ca n be initiated that survey must be submitted. Within <br />30 days of acceptance of Departmental action to approve the mine plan applica- <br />tion, the operator shall submit to the regulatory authority the results of the <br />lek survey and what mitigation procedures will be used to minimize impacts to <br />sage grouse and their habitats. <br />16.. Adequate protection is not provided for active golden eagle nests <br />adjacent to the mine site. Therefore, the following described lands are <br />classified as unsuitable for surface disturbance and occupancy. Periodic <br />activity during the non-nesting season (.tune 1 - February 28) within the <br />buffer zone can be approved on a case-by-case basis: <br />
