This permit may be renewed upon expiration for areas within the <br />boundaries of the permit in. ac cordance with the Surface Mining Act, the <br />approved Colorado State Program and the Federal Lands Program. <br />4. This permit may not be transferred, assigned, or rights under the permit <br />sold without the approval of the Director, Office of Surface Mining. <br />5. Western Fuels-Utah, Inc., shall conduct all underground coal mining and <br />reclamation operations as described in the complete application together <br />with the special stipulations (Attachment 1). Accordingly, "term of the <br />permit" or "condition of the permit" as used in the following paragraphs <br />also includes all operations as described in the complete application. <br />6. Western Fuels-Utah, Inc., shall allow the authorized representatives of <br />the Secretary, including but not limited to inspectors and fee <br />compliance officers, and the Colorado Mined Land Reclamation Division, <br />without advance notice or a search warrant, upon presentation of <br />appropriate credentials, and without delay, to - <br />~' <br />~'. <br />a. Have the rights of entry provided for in 30 CFR 840.12 and 84T.13; <br />and <br />b. Be accompanied by private persons for the purpose of conducting an <br />inspection in accordance with 30 CFR 842, when the inspection is in <br />respose to an alleged violation reported by the private person. <br />7. Western Fuels-Utah, Inc., shall conduct underground coal mining and <br />reclamation operations only on those lands specifically designated on <br />the maps submitted in the complete application and approved for the term <br />of the permit and which are subjecC to the performance bond. <br />8. Western Fuels-Utah, Inc., shall take all possible steps to minimize any <br />~~ ~ adverse ~Wpact to the environment or public health and safety resulting <br />from noncompliance with any term or condition of the permit, including, <br />but not limited to: <br />a. Any accelerated or additional monitoring necessary to determine the <br />nature and extent of noncompliance and the results of the <br />noncompliance; <br />. b. Icnoediate implementation of measures necessary to comply; and <br />c. Warning, as soon as possible after learning of such noncompliance, <br />any person whose health and safety is in imminent danger due [o the <br />noncompliance. <br />
