C-56447 <br />continued public and coal operation access to the Dr_v Fork of iinnesota <br />Creek area: • <br />Forest Development Road 711.2 - Dry Fork of Minnesota Creek Road. <br />Forest Development Road i11.2B - Apache Rocks Road. <br />The non-sVStem exploration road which junctions with the Apache Rocks Road <br />and goes in a generally easterly direction to West Flatiron is not open to <br />public full-size vehicular traffic, but is necessary for continued <br />activities associated with coal mining in the West Flat Iron area. <br />A11 three of these roads are granted exceptions. <br />For the purpose of: <br />The management of wetlands and floodplains are subject to Executive Orders <br />11990 and 11988, respectively. The purpose of the EO's are to avoid to the <br />extent possible the long and short term adverse impacts associated with the <br />destruction or modification of wetlands and floodplains and to avoid direct <br />or indirect support of new construction in we~lands wherever there is a <br />practical alternative. <br />ALso, it is recognized chat there is a direct relationship between impacts <br />on such areas and effects on water quality and aquatic ecosystems. There <br />is a high risk of irreversible and irretrievable impacts on the latter with <br />operation and developments in wetiands, floodpiains and riparian areas. <br /> <br />It may become nadessar•: for a waiver, exception or modification (WEM) to <br />this stipulation for the operator/lessee co use the surface in the area <br />covered b•; this stipulation to allow for the recovery of the coal reserve.. <br />WE<Y's to this stipulation ..rill be considered only at the time operations <br />are proposed, and will be subject to the Forest Land and Resource <br />Management. Plan in effect ac the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a :IEM is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service -reserves the <br />right to impose other st'_pulations in the same area of this leasehold if a <br />WEM is granted. <br />Conditions under which a WEM may be granted: <br />If it can be shown chzough environmental analysis and the application of <br />mitigation measures chat the impacts to wetland, floodplain and riparian <br />resources will be minimized and chat no other alternative location for <br />facilities and activities associated with coal mining is practical because <br />of environmental effects and operational considerations (eg, economics, <br />health and safety, etc.). <br />Any changes to this stipulation will be made in accordance with the Land use <br />plan and/or the regulatory provisions for such changes. (For guidance on the <br />use of this stipulation, see BLM Manual 1624 and 3400 or FS Manual 1950 and <br />2820.) <br />Coal-NSO-WFR 2/95 <br /> <br />
