Gunnison No. 1 <br />Mine Mining Plan Modification for Federal Leases <br />C-1362, C-0117192, and D-044569, Gunnison County, <br />Colorado <br />I recommend approval with conditions of the Weat Elk Coal <br />Company's Mt. Gunnison No. 1 mine mining plan modification <br />for Federal leases C-1362, C-0117192, and D-044569 pursuant <br />to the Mineral Leasing Act of 1920, as amended. This <br />mining plan modification supplements the Mt. Gunnison No. 1 <br />mining plan for Federal leases C-1362, C-0117192, and <br />D-044569, approved on July 15, 1981 and modified on <br />August 16, 1985, September 27, 1985, and November 21, 1987. <br />My recommendation to approve the Mt. Gunnison No. 1 mine <br />mining plan modification is based on: (1) West Elk Cosl <br />Company's complete technical revision application, (2) <br />compliance with the National Environmental Policy Act of <br />1969, (3) documentation assuring compliance with applicable <br />requirements of other Federal laws, regulations, and <br />executive orders, (4) comments and recommendations or <br />concurrence of other Federal agencies, and the public, (5) <br />the findings and recommendations of the Bureau of Land <br />Management with respect to the resource recovery and <br />protection plan and other requirements of the Federal <br />leases and the Mineral Leasing Acts, and (61 review of the <br />technical revision application by the Colorado Mined Land <br />Reclamation Division as required by the Colorado State <br />program and cooperative agreement. <br />The Secretary may approve a mining plan modification for <br />Federal leases under 30 U.S.C. 207(cl and 12731c). <br />Pursuant to 30 CFR Chapter VII, Subchapter D, I find that <br />. the proposed mining plan will be in compliance with all <br />applicable laws and regulations. The decision document for <br />the proposed mining plan action is attached. <br />Attachment <br />
