Berry
DMSION OF MINERALS AND GEOLOGY
Office of Mined Land Reclamation
1313 Sherman Stmt, Room 21S
Denver, CO 80203
Re: West Elk Mine, Permit No. C-80.007, Response the Division's Letter of January 13, 1994,
Regarding Larry Mentz Complaint
Dear David;
Tho following arc Mountain Coal Company's (MCC) responses to the questions presented in
your latter of January 13, 1994, regarding the Larry Mautz complaint. MCC's responses are
provided in the same order es the questions in your letter.
1. MCC believes that all springs in the Lone Pine Gulch drainage that were present at the
time (late 1970'x) were identified doting the original hydrologic survey conducted by Woodward-
Clyde Consultants. MCC also believes t<~et all springs present in Lone Pine Gulch as of last
Summer have been identified. Note that a large pert of the drainage is formed of landslide debris
(reference "Photogeologic Map of the Jumbo Mountain Ares," Intresearch, Inc., September 29,
1993) and that springs in the arcs have been documented (prior to mining) to have relocated (e.g.,
G26 to G26e) dub to landslide sctivity. Monitoring of spring G26 was in fact discontinued in
1986, because landslides blocked access in Lone Ana Gulch. Spring CR-12, the adjudicated right
called Jumbo Mountain Spring No. 3 Pond, was identified and mapped in an area below the F-
seem outcrop (outside the original effected permit area and not affected by subsidence).
2. MCC believes that the description provided in question No. 2 of the Division's letter of
January 13, 1994, end as shown on Map 2 of MCC'e permit C-80-007, is current and accurate.
3. Yes, MCC believes that ell "structures" in Lone Pine Gulch have been irrventoried and ~ L•! ~S
have be6n described in the permit document as suggested by the Division. N was stated in ~ ;~~ _, ~ St, ,, ,
MCC's original permit document, the structure inventory presented did not include structures or ~~~ , ~, J ...
remnants of such located below the F-:cam outcrop (outside the original affected ptxmit area). a ; t a , ..
The structure remnaete in Lone Pine Gulch were not previously included with the discussions of , . , .
the Sylvester Gulch and upper meadow remnants for this reason.
