It is also
understood that Tri-State will be responsible for reclaiming all disturbances
at the mine site which are a result of their activities. This reclamation,
which may include, but not be limited to grading and revegetation, will be
completed to the satisfaction of Peabody Coal Company.
Concerning the construction of power transmission structures; this activity
will require two technical revisions to the Seneca II permit.
A. The postmining land use at the proposed structure sites must be changed
to industrial.
B. The proposed structure sites must be deleted from the approved permit
area.
Construction related disturbances at the proposed power transmission structure
sites shall not begin until the required revisions have been approved by the
Division.
This letter does not implicitly or otherwise release Peabody Coal Company from
reclamation liability at the Seneca II mine site.
