SHELTO N, Director <br />May 9, 1986 <br />Mr. Tom Wainwright <br />Peabody Coal Company <br />Drawer D <br />Hayden, Colorado 81639 <br />Re: Tri-State Power Generation and Transmission Association, Inc. <br />Access Roads - File No. C-80-005 <br />Dear Mr. Wainwright: <br />This letter is to clarify the Division's position regarding the power pole <br />access roads by Tri-State Power Generation and Transmission Association, Inc. <br />on undisturbed lands at the Seneca II Mine. <br />It is the Division's position that Tri-State can, upon submittal of the <br />appropriate maps, develop two access roads to the poa+er mine site. It is also <br />understood that Tri-State will be responsible for reclaiming all disturbances <br />at the mine site which are a result of their activities. This reclamation, <br />which may include, but not be limited to grading and revegetation, will be <br />completed to the satisfaction of Peabody Coal Company. <br />Concerning the construction of power transmission structures; this activity <br />will require two technical revisions to the Seneca II permit. <br />A. The postmining land use at the proposed structure sites must be changed <br />to industrial. <br />B. The proposed structure sites must be deleted from the approved permit <br />area. <br />Construction related disturbances at the proposed power transmission structure <br />sites shall not begin until the required revisions have been approved by the <br />Division. <br />This letter does not implicitly or otherwise release Peabody Coal Company from <br />reclamation liability at the Seneca II mine site.
