review was conducted concurrently with PR-5 review; proposed decision on RNA will be <br />issued shortly after issuance of the PR-5 proposed decision. Worst case liability of <br />$10,203,663.00 was calculated, an increase of $496,290.00 over the current bond amount <br />held. SCC responded that the liability increase was not warranted. The parties exchanged <br />several letters regarding cost estimate tasks and assumptions, and SCC provided further <br />relevant documentation, <br />SCC submitted a letter requesting extension of the PR-5 review timeframe on November 4, <br />2005, indicating they would need additional time to respond to the preliminary adequacy <br />review letters. SCC submitted an adequacy response package of amended text, designs, <br />and map exhibits dated January 31, 2006, received by the Division on Februray 2, 2006. <br />The Division prepared a final adequacy review letter dated March 14, 2006. Remaining <br />issues included questions regarding certain disturbance area delineations, backfill stability <br />analysis, topsoil redistribution plan, permanent channel designs, shrub establishment <br />details, and seedmix adjustments. The letter also included an amended cost estimate that <br />had been prepared based on information provided by SCC. The revised estimated liability <br />amount was $9,517,161.00, which is $190,212.00 less that the current bond amount held, <br />$9,707,373.00. <br />The BLM Little Snake Field Office provided Notification of approval of Resource <br />Recovery and Protection Plan and Logical Mining Unit modification associated with PR-5 <br />amendments in a letter of March 15, 2006. <br />SCC submitted a final adequacy response package on May 17, 2006. <br />The Division queried the Applicant Violator System (AVS) on several occasions during the <br />PR-5 review, and there were no violations listed; recommendation based on the AVS <br />checks was "Issue°. <br />Description of the Environment <br />The Seneca II-W Mine is located in northwest Colorado approximately 7 miles south of Hayden <br />in Routt County. The Seneca II-W Mine lies 7 miles west of the Seneca II Mine, Permit No. <br />C-80-005 and 3.5 miles west of the Yoast Mine, Permit No. C-94-082. See Figure 1 for further <br />detail. The mining area can be found on the Hayden, Hayden Gulch, Mount Harris and Dunkley <br />Quadrangles 7.5 Minute Series Maps. The coal from Seneca II-W was hauled over county and <br />private roadways by private hauler to the Hayden Station Power Plant operated by Public Service <br />of Colorado. Haulage distance is, approximately ten miles each way.
