L.K,A. tinerals - 2 - November 28, 1986
The second problem involves the status of these two mining operations. Your
annual reports state that these mining operations have been idle since
December 14, 1984. Please be advised that Rule 1.6 of the Rules and
Regulations for Minerals has recently been revised by the Mined Land
Reclamation Board to more clearly delineate the duties of an operator whose
mining operation is in a state of temporary inactivity. A copy of this new
Rule is enclosed.
Please review this Rule carefully and notify our Division concerning the
status of your operations. If the operations are in temporary cessation
(as almost certainly appears to be the case), please submit Notices of
Temporary Cessation that comply with the requirements of Rule 1.62. The start
of the five-year temporary cessation periods should be specified in the Notice
and should be the date on which the mining operations ceased (in this case
probably December 14, 1984), If, on the other hand, the mining operations
should not be considered to be in temporary cessation, please outline the
reasons that these operations should still be considered to be active.
Failure to file proper Motices of Temporary Cessation can result in violations
to your permits being found by the Mined Land Reclamation Board, or even
termination of your life-of-the-mine permits for these operations. Please
respond to this letter within 30 days to avoid further Division action on this
matter.
Please call if you have questions about either of these problems.
Sincerely,
~.
Mark S.
