As stated, BLM may properly preclude mining operations within the Community <br />Pit boundaries for so long as [he permit designation remains in place. The Decision indicates that BLM <br />properly established the community pit on land for which you could no longer assert a valid interest. It <br />further asserts that even if mining should be allowed in the future, it would clearly have to be for qualitying <br />end uses. This would require more thorough documentation and convincing proof of a d'uect tie, such as, <br />convacts, etc., [o actual and ongoing qualifying markets. Limestone is no[ considered to be subject to <br />location in the absence of viable qualifying uses. Therefore, given the above, we cannot approve your <br />request for removal of the material. <br />Regarding reclamation, we will have Bob Elderkin continue to work with Greg Lewicki on formulating a <br />final reclamation plan.
