Box 445, Telluride, CO 81435 <br />(970) 728-3775 • Fax (970) 728-3015 <br />December 29, 1997 <br />RE: Expansion of Use Exhibit for Article 4-210 <br />The areas where the building have been constructed are all within our permitted azea with the <br />Department of Minerals and Geology. We are already required to revegetate according to that <br />permit, which encompasses the entire 20+ acres of our operation and not just the 0.1 acres of the <br />building footprints. <br />Again, this article seems to be written for an expansion of area. Since we are only trying to obtain <br />building permits for existing buildings, this article does not seem to apply. If a copy of our <br />Department of Minerals and Geology permit is required, please let me know. <br />I have been talking to the DMG about our Permit, since the Counry has directed us to amend the <br />size of our lease. Once this new lease has been recorded, we will have to report that to the DMG. <br />In turn, they will come out and inspect the land which we no longer have under lease to see if it <br />has been remediated to the Terms of the Permit. If it has been done to the Terms in the Permit, <br />they will amend our Permit to match the new lease acreage. <br />
