-19- <br /> <br />VIII. Water Rights and Replacement - Rules 2.04.7(3), 2.05.6(3)(a)(ii) <br />2.07,6(2)(c) and 9.05,15 <br />The applicant has provided information on water rights in the vicinity of the <br />mine site in Section 2.09.7(I), (pg. 87) and information regarding alternative <br />water supply and consumptive use requirements beginning in Section 2.05.6 <br />(pg, 233) of the permit application. The only potential for damage to any <br />existing water right pertains to the Suppa well at the west end of the permit <br />area. The applicant has sufficient resources to augment any damages to this <br />right and the source will be monitored to determine any changes in water <br />quantity or quality which may result from the operation. <br />Appropriate materials were provided to the Office of the State Engineer, <br />Colorado Division of Water Resources, for an opinion on potential damage to <br />existing water rights. The State Engineer's office has no objections to the <br />proposed decision, but has recormnended the addition of a stipulation to the <br />permit. The recommendation regards two wells, numbers 022321F~and 022320F, <br />the rights to which have recently been accuired by the applicant. Pursuant <br />to the Rules and Regulations of the Arkansas River and its tributaries <br />(reference Water Division 2 Court Case W-470), the applicant is allowed to <br />pump water from each well for a period not to exceed 72 hours per week. <br />The following stipulation is, therefore, necessary: <br />Stipulation No. 4: <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, THE PER1~f7TTEE MUST SERVE NOTICE <br />TO THE COLORADO WATER RESOURCES DIVISION 2 OFFICE IN PUEBLO STATING <br />THAT THEY WILL ONLY PUMP EACH WELL A FtAXIMUM OF 72 HOURS DURING <br />RNY ONE WEEK PERIOD. <br />With the acceptance of the above stipulation, the operation is in compliance <br />with the requirements of this section. <br />IX, Probable Hydrologic Consequences and Cumulative Impacts Assessment - <br />Rules 2.05.6(3) and 2.07.6(2)(c) <br />Probable Hydrologic Consequences <br />The applicant has provided a statement of probable hydrologic consequences <br />for the operation in Section 2.05.6 (beginning on pg. 238) of the permit <br />application. The operation could impact the hydrologic system through <br />1) impacts on surface water quality and quantity resulting from surface <br />disturbances and mine water discharge, 2) impacts on ground water quality <br />through mine water inflows, and 3) impacts on ground water quality through <br />infiltration of surface water through exposed unweathered material. In all <br />three cases, the Division has determined that the probable hydrologic con- <br />sequences will be minimal. 1,/ <br />F j <br />.1 ~ '! ~~ <br />~/~ z a~~.~ 4. <br />
