Lxhhead Executive Drrector Michael B. Long Division Director The Division has received a copy of the above mentioned report. Submittal of the report satisfies, for 1994, the annual submittal required by Stipulation 31 to the Edna Mine pertmt. The report indicated that check dam construction, and the pond inlet armoring in lieu of dams 22 and 23 are now complete. Observations of the dams and pond inlet by Division personnel indicate the dams appear to have been properly constructed, demonstrating excellent workmanship. The construction schedule presented in Appendix 4.6-M predicted check dam completion during the 1993 season, with approximately seven terraces completed in the 1994 constructlon season. The 1994 report notes that accelerated grading of the pit area impeded terrace construction due to manpower and equipment availability. P&M notes, however, that completion of the project in 1995 remains viable. The Division agrees that with a concentrated effort, completion ]n 1995 remains possible. Please be aware that in order to delay completion of the project, climatic conditions or other circumstances beyond P&M's control would have had to occur. It is the Division's position that to date, these conditions have not occurred, and a delay in the schedule would not be warranted at this time.
