As of the date of this letter, the Division has not received Basin <br />Resources' application, per Rule 2.08.5(2), for the two permit renewals mentioned above. <br />Therefore, pursuant to Regulation 2.08.5(3)(f), if the permit renewal approval decision is not <br />issued by January 25, 1994, mining activities, including the shipping of coal, must be cur- <br />tailed on that date at the Golden Eagle and New Elk Mines. Mining and shipping of coal <br />cannot resume until such time as the renewal decision is finalized. Only reclamation <br />activities will be allowed to proceed in this interim period.
