<br />I. STATTM6.NT OF TAE CAST
<br />1. Plaintiff, SW Villaneautc, LLC, owns real property historically lmowa as tha
<br />Poiteet Seepage Ditch, in Wald Coutrry, Colorado. SW Villeneaux, LLC, and TKO, LLC, own
<br />property in Weld County, which beuelit from and use the Porter Seepage pitch and the Ogilvie
<br />Ditch.. SW TKO ]oiiut Veoture, LLC, is a Colorado limited liability company formed to develop
<br />~ ProP~Y awned by SW Villaaeaux, LLC and TKO, LLC. Plaintiffs bring tbi3 action for,
<br />among other things, an injunction preventing the resttictioa of use of Plaintiffs' right to use the
<br />Porter Seepage Ditch which traverses State Highway SS and Defendant Chavrrs' property.
<br />Additionally, Plaintl~k bring this action far an injunction preventing the restriction of the right to
