Cattany <br />Division Director <br />Natural Resowce 7mstee <br />On July 12, 2006, the Forest Lakes Metro District informed the Division of their immediate need <br />to construct several dikes across the large wastewater polishing pond to enhance performance <br />of the treatment plant. Additionally, the District intended to excavate the construction materials <br />from a previously disturbed area which is the future location of Cell 3 of the waste treatment <br />plant. The plant is regulated under CDPHE, CDPS municipal waste water treatment and <br />discharge permit COG-584025. At that time the Division responded that the excavation activity <br />appeared to satisfy the third exemption of the Board's Policy dated April 29, 2004, and would <br />therefore, not need a reclamation permit from this office. Additional details are fisted in the <br />Division's report generated from its July 12th inspection of the area. <br />On July 13, 2006, the Division received written response to our inquiry, "Need For State <br />Reclamation Permit", which provided additional explanation of the proposed excavation activity. <br />Please note that the Division's opinion remains as stated on July 12th, that the excavation <br />activity proposed at Cell 3 of the treatment plant appears to be exempt from reclamation permit <br />requirements.
