-59- The coal loadout facility is located within the proposed permit area. There will be no in situ coal processing operations at the site. Since this is an underground mine, provisions pertaining to mountaintop removal, steep slope mining and angering operations are not applicable. There are no surface mining activities adjacent to the proposed permit area. The proposed operation is in compliance. XXIII. MISCELLANEOUS COMPLIANCE (2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.28, 4.30 The following categories are applicable to this section: Surface Mining Near Underground Mining Signs and Markers General Requirements Slides and Other Damage Protection of Underground Mining Coal Processing Plants and Support Facilities Not Located At or Near the Mine Site or Not Within the Permit Area for the Mine Cessation of Operations The application was reviewed to determine compliance with the above categories and applicable regulations. The Division finds the application in compliance with the requirements of this section. XXIV. OPERATIONS a IMITATIONS OR PROHIBITIONS - RULES The Division reviewed the application with respect to Rule 2.03.7 and 2.07.6(2). The Division finds that the operation is not included within an area designated unsuitable for surface coal mining operations in an administrative proceeding begun under Rule 7 or 30 CFR 769 of the Federal Regulations. The operation is in compliance with the requirements of this section. XXV. DEMONSTRATION THAT SURFACE COAL MINING TI Based on the information supplied in the application, the Division finds, in accordance with Rule 2.07.6(2)(b), that the proposed mining and reclamation activities can be feasibly accomplished. The application is in compliance with the requirements of this section. XXVI. COMPATIBILITY WITH ANTICIPATED ADJACENT OPERATIONS (2.07.6(2)(1) Orchard Valley mine's proposed operation is not inconsistent with operations anticipated to be performed in adjacent areas.
