-2- Roatcap Creek drainage is proposed in this permit revision to be used to build a temporary portal. This portal would remain active for approximately 2 years after construction. Thereafter, it would be used as a ventilation shaft. This revision also has provisions for the construction of a haul road from Steven's Gulch to the proposed portal site. The entries of the proposed portals will run northwest until they intercept the mains of previously approved mine plan. Other than these entries and a change in the sequencing of mining there will be no significant change to the previously approved mine plan. This "Findings of Compliance" document will supersede the findings proposed on June 20, 1985. C-038-83. This document also takes into consideration any stipulations imposed on Permit C-038-83 by reinforcing those stipulations that still apply. This document contains the "Proposed Decision to Approve the Permit Application"; a description of the environment affected by the mining operation and the operation and reclamation plan; and the Division's written findings of compliance required by the Colorado Surface Coal Mining Reclamation Act. Detailed information concerning the review process is on file at the Division offices, legal requirements can be found in the Act and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. All rules referenced in this document are contained within the Regulations.
