In response to your request, expressed to me during our telephone conversation on September 20, 2004,
enclosed are the following items:
1) Selected portions of the Westhoff Permit Application which include the legal description, map of
the permit azea ,mining plan and reclamation plan.
2) A copy of the section of the Division's Rules and Regulations which addresses the requirements
for the use of off site materials for fill on the permit areas.
3) A copy of Gary Westhoff's letter of October 23, 1989 which states that they have come to an
agreement with Walter Longacre concerning mining that may be taking place outside the
boundaries on the north boundary. We aze also providing you with the DMG cover letter of
November 8, 1989 to Walter Longacre, which included a copy of the October 23,1989 Westhoff
letter and a request that the Division be notified if you (Mr. Longacre) did not believe that your
problems had been taken caze of.
