<br />SECTION B <br /> <br />The following findings and specific approvals are required by Rule 4 <br />Roads - Rule 4.03 <br />A. Haul Roads <br />The Division proposes to approve the retention of portions of <br />the haul road depicted on Map No. 1 in the permit application <br />package since it is compatible with the approved post-mining <br />land use. <4.03.1(1)(fl(i)). <br />II. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />The Division proposes to grant a small area exemption from use <br />of sediment ponds due to the limited size of the area and due to <br />the fact that ponds and treatment facilities are not necessary <br />for the drainage to meet the effluent limitations of Rule 4.05.2 <br />and applicable State and Federal water quality standards for <br />receiving streams and also due to the fact that no mixing of <br />surface drainage with a discharge from underground workings will <br />occur. The small areas to be exempted are the areas at the <br />water storage tank, explosives storage, ventilation entry, <br />alluvial well pump, Halandras trash dump, the overland conveyor, <br />the D portal topsoil stockpile, and the South and East portions <br />of the Slot Storage area. (4.05.2(3)(b)(i)). <br />Stream Channel Diversions <br />The Division proposes to approve the diversion of an ephemeral <br />stream draining at least one square mile. Scullion Gulch has <br />been diverted with a large diameter pipe culvert such that it <br />passes beneath the D Portal facilities area. The decision to <br />approve this diversion is based on a finding that the proposed <br />diversion meets the requirements of 4.05.18 and 4.05.4, <br />applicable local, State, and Federal statutes and regulations <br />and that the diversion is designed to safeguard public safety <br />and to minimize adverse impacts to the hydrologic balance. <br />(4.05.4(1) and (4)). <br />-10- <br />
