Federal regulations require protection or mitigation for sites meeting <br />criteria for eligibility to the National Register and one such site, <br />(5RT345) a rock shelter/rock art site, exists within the permit area. <br />The site will not be impacted by proposed operations. <br />Consultation with Mr. Jim Green of the State Historical Preservation <br />Office (SHPO) has confirmed that the Foidel School is the only listed <br />site within the proposed permit area. <br />Based on information presented in the application and consultation with <br />the SHPO, the Division finds, pursuant to Rule 2.07.6(2)(d)(iv)(e)(i), <br />that the proposed operations will not adversely affect any publicly owned <br />park or place listed on the National Register of Historic Places. <br />IV. Climatological Information and Air Resources - Rules 2 <br />Climatological information for the proposed permit area is given on pages <br />2.04-40 through 2.04-45. An air pollution control plan is found on page <br />2.05-81, and copies of approved air emission permits are included as <br />Exhibit 29. <br />This section is in compliance. <br />V. Geology - Rules 2.04.5 and 2.04.6 <br />A description of the geology within the permit area is located in section <br />2.04.6, Volume 1 of the life of mine application. This description is <br />documented with material found in Exhibit 12, and Maps 6 through 12 in <br />the Confidential Volume. Additional information may be found in Figures <br />1 and 2 in Volume IV and Map 5 of Volume V. <br />The applicant has presented the geochemical analyses and leach tests of <br />waste rock and roof, floor and coal strata within the permit area. The <br />results are presented in Exhibits 10 and 11, found in the Confidential <br />Volumes, and in Exhibits 27, 31, 36, 37 and 38 of Volume III. Tables 62 <br />and 66 and Figures 8 and 9 in Volume IV also provide supporting <br />documentation. <br />The chemical qualities of leachate from the coal seam and the Wadge <br />overburden were discussed briefly during the permit review process. The <br />Division was concerned about phytotoxicity from high SAR's of the <br />revegetated waste rock pile and about the quality of waters discharging <br />from future abandoned flooded workings into Fish Creek. <br />Development waste from the mine is disposed of in the western end of the <br />Area 2 pit originally opened by CYCC. The concern with regard to <br />potential detrimental effects of the development waste on revegetation <br />was resolved by the applicant's commitment to cover the waste rock with <br />at least 4 feet of non-toxic overburden prior to topsoiling. <br />_1 P_ <br />
