L°"g <br />Divivon O~reclor <br />Thornton, CO 80233 <br />RE: Structure Agreements & 404 Permit Application, Cooley Reservoir & Fulton Wildlife Area <br />Permit No. M-99-034 <br />Dear Mr. Fleming: <br />Thank you for submitting copies of the agreements between CAMAS Colorado, Inc. and the <br />Fulton Ditch Company as well as Public Service Company of Colorado for permanent man-made <br />structures pertaining to the above mentioned permit. The Division has also received a copy of <br />the 404 Permit Application for the above mentioned permit. For clarification, please note the <br />following items with respect to the 404 Permit and wetlands issues: 1) the applicant has <br />committed to no disturbance of existing wetlands until a 404 Permit has been issued, 2) the <br />applicant has committed to submittal of a technical revision to include a wetlands mitigation plan <br />and reclamation costs associated with created wetlands, and 3) the 404 permit application <br />received contains spazse information on site grading plans, water table elevations expected <br />throughout the year, and specific costs for grading and revegetation. (This information will need <br />to be provided prior to Division approval of the revision request). <br />The Division appreciates your cooperation in these matters and looks forward to your revision <br />submittal.
