UI n~a tiirc~ Oa~~._~~e r, <br />Paragraph 2 of your letter is a complete reversal of 3 or 4 instances of <br />past refusal to take action outside the permit area, even where human Iives <br />were threatened. Evidence and witnesses are available. <br />I charge you to produce evidence that anything I did is any threat! The <br />60 year old coal mine posed no problem until Sun Coal and you built a pond <br />above a known underground coal mine. Sun Ccal and your offir_e knew of this <br />before Sun Coal started operation. The area where SCS had approved the pond <br />(to be sealed with Bent~nite) is at least 1600' south and slopes away from <br />the old underground mine. In May 1980 your RydroIogist directed Sun Coal <br />to install a culvert o* otherwise keep haul road water off the slide area. <br />Their are many witnesses:., <br />Paragraph 3 Sun Coal installed water bars at your direction below culvert <br />112 and caused the damage you describe. My 5 minutes work at the tree above <br />the culvert only served to direct the water off the slide area. Your Para- <br />graph 3 is completely wrong! Mr. Mattews saw the area and said nothing to Me <br />about any required work. Mr. Bloomquist was present and is ready also to <br />testify about the fuel screen which I found at the site. Mr. Mattews report <br />does not mention anything about the hazardous steel stakes, as I requested. <br />Two years and you still have not removed this very serious hazard. <br />Paragraph 9 The contract written before the current law was passed calls for <br />terracing the disturbed land. Please be specific and quote the law that <br />prohibits this? It costs less when done properly to terrace the land than <br />it does to "Kinda put it back the way it was". Your experiments at Seneca <br />Mine have caused nothing but problems and cost the consumer extra. Also <br />witness that your approved plan of this area has now killed one of My calves. <br />The renter at the Stone lrouse moved out partilly dt~e to this additional <br />hazard which you created. See enclosed statement. <br />Sun Coal recently closed two open mine shafts. They were open 2 years. <br />Where were your inspecters? Because of evidence which I have, you will be <br />required to reopen the area and ascertain if any cows are buried there. <br />Because of the aformentioned problem and the fact that you and Sun Coal have <br />done nothing to date, we request that your 14 August letter be @*&@!!S~C@!!! <br />We have requested a complete and unbiased investigation of Sun Coal and your <br />operation. <br />We expect a reply by regular mail within 5 days. <br />Respectfully, tY~ I~^~ <br />n { r <br />( j/f . <br />
