..~~' <br />V. SUMMARY AND CONCLUSIONS <br />CYCC requested Phase III release from the lands delineated on Figures 3 and 5 of the bond release <br />submittal package. The Division reviewed the bond release application, the mine permit, and <br />inspected the lands. Based on the review and inspection, the Division finds that on the bond release <br />lands, CYCC has: <br />1) Applied for final bond release no less than l0 years after the last year of augmented <br />seeding, fertilizing, irrigation or other work; <br />2) Successfully completed all surface coal mining reclamation operations in accordance <br />with the approved reclamation plan; and <br />3) Fully met all reclamation requirements of the Rules and the Act. <br />VI. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve CYCC's request for a Phase <br />Phase III bond release for Mine l and the Eckman Park Mine. This proposed decision will release <br />CYCC from liability for reclamation work on the bond release blocks. <br />The Division currently holds a performance bond in the amount of $1,561,099 from CYCC. The <br />Division proposes to release the entire bond amount and terminate jurisdiction on the lands <br />covered by mining and reclamation permit C-81-071. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Section 3.03.2(6). Public notice of this proposed decision will be published twice in the Steamboat <br />Pi/ot for two weeks as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within thirty days of the first publication in the Steamboat Pi/ot. if no heazing <br />is requested within that thirty days, the Division's decision will become final. <br />Mine 1 and the Eckman Park Mine Page 14 January 3, 2002 <br />Phase III Bond Release <br />
