<br />Surface Water Impacts: <br />10. Since CYCC began mining operations, flows in Foidel Creek and Middle Creek have <br />changed from ephemeral to perennial, possibly due to spoil spring inflows. <br />11. CYCC's spoil spring discharges load Foidel and Middle Creek with dissolved solids. <br />12. The loading with dissolved solids has not resulted in violations of NPDES limitations or <br />instream standards for at least the last five years. <br />13. Sustained stream flows, and the compliance with NPDES discharge limitations and <br />instream standazds, indicate CYCC has prevented material damage to the surface water <br />hydrologic balance outside the permit. <br />14. The pastureland post-mining land use in the permit area has not been impaired by the <br />changes to the hydrologic balance caused by CYCC. The changes were the minimum <br />that can be expected from a surface mining operation. <br />15. Surface water pollution currently being caused by CYCC's mining operation, if any, <br />should continue at the current level because CYCC's spoil leachate quality appears to <br />have reached long-term stability with TDS concentrations of around 4,000 mg/I. This <br />quality can be expected to continue for several hundred years, as predicted for the nearby <br />Seneca II Mine (USGS Water-Resources Investigations Report 92-4187). <br />Impacts to Alluvial Valley Floors (AVFs): <br />16. CYCC's mining operations did not physically disn~pt the three AVFs that are <br />downstream from the mining operation. There are no AVFs within the permit area. <br />17. Sustained stream flows in Foidel and Middle Creek since CYCC's operations began <br />indicate CYCC has not depleted the supply of water to the three AVFs. <br />18. The quality of surface and alluvial waters downstream from the three AVFs either <br />remains below material damage suspect levels or is no worse than pre-mining quality <br />(see Table 7, below). <br />Mine 1 and the Eckman Park Mine Page 12 January 3, 2002 <br />Phase III Bond Release <br />
