The Water Quality Control Division administers a stormwater program, designed to <br />control stormwater runoff from certain categories of industrial activity, including mining. Your <br />facility falls under one of these categories. Our records indicate that you have not applied for or <br />obtained a stormwater permit for the above - referenced mining operation. <br />Background <br />In 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges <br />from mining sites (and other industries) as requiring Clean Water Act controls. In 1990, EPA issued <br />regulations that require specific mining activities to obtain permits in order to discharge storinwater <br />from their facilities. <br />The stormwater regulations apply to active and inactive mines, if runoff contacts overburden, raw <br />material, intermediate or finished product, or waste products, and leaves the site. <br />The Water Quality Control Division of the Colorado Department of Public Health and Environment <br />has direction and authority to administer this program in Colorado. The Division has issued a general <br />permit for Sand and Gravel Mining and Processing (and other nonmetallic minerals except fuel). <br />Application Requirement <br />An application form for the General Permit has been enclosed. Please complete an application for the <br />site and submit it to our office by August 3, 1995. Note that the application must include notice of <br />preparation of a Stormwater Management Plan (SWMP), as described in Appendix A of the <br />application. (The plan itself does not need to be submitted.) <br />
