Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, a permit renewal for the Colorado Coal Mine No. 1. This <br />approval allows only reclamation. Life of mine approval is not being granted <br />by this decision. <br />The proposed renewal applies to the area described on Map 1 of the permit <br />application. The area lies within all or a portion of Sections 25 and 36, <br />T27S, R67W in Huerfano County, Colorado. <br />This proposed decision is based on a finding that the proposed operation as <br />described in the permit application and permit renewal application will comply <br />with all requirements of the Colorado Surface Coal Mining Reclamation Act, <br />CRS 1973, 34-33-101 et seq. and the Regulations promulgated pursuant to the <br />Act. <br />The permit application and permit renewal application and the stipulations <br />will become a binding part of the permit upon approval. All responses to <br />stipulations must be prepared in a manner so as to be inserted into the permit <br />application. In addition, they must be submitted as revisions to the approved <br />permit. <br />The stipulations for the Colorado Coal Mine No. 1 are as follows: <br />Note: The stipulations listed are numbered in the same order as they were <br />given in the 1983 Findings Document. Stipulations not included below have <br />been deleted from the 1989 Permit Renewal for the reasons given in the text of <br />the 1989 Findings Addendum. <br />List of Stipulations <br />Stipulation No. 7 <br />AT LEAST 60 DAYS PRIOR TO USE OF HERBICIDES OR PESTICIDES, THE PERMITTEE <br />SHALL SUBMIT A PLAN FOR THE USE OF SUCH CHEMICALS, INCLUDING, AT A <br />MINIMUId, RATE AND METHOD OF APPLICATION, AND THE NAME OF THE SPECIFIC <br />HERBICIDE AND OR PESTICIDE TO BE USED. THE APPLICANT MUST RECEIVE <br />WRITTEN DIVISION APPROVAL PRIOR TO THE USE OF ANY HERBICIDE OR PESTICIDE. <br />Stipulation No. 17 <br />THE PERMITTEE SHALL SUBMIT ABANDONMENT REPORTS IN ACCORDANCE WITH RULE <br />4.07.3(3) WITHIN 60 DAYS AFTER ABANDONMENT OF ANY HOLE OR WELL THAT IS <br />DRILLED AND/OR ABANDONED AFTER PERMIT ISSUANCE. <br />Stipulation No. 21 <br />THE PERMITTEE MUST OBTAIN LEGAL RIGHT OF ACCESS TO SECTION 36 FOR THE <br />PURPOSE OF PERFORMING APPROVED RECLAMATION ACTIVITIES. SUCH RIGHT OF <br />ACCESS MUST BE OBTAINED PRIOR TO ENTERII~ THIS SECTION. THE RIGHT OF <br />ACCESS MUST BE OBTAINED WITHIN 30 DAYS OF THE PERMIT RENEWAL APPROVAL. <br />Stipulation No. 22 <br />RECLAMATION OF THE MINE, FOLLOWINv THE APPROVED RECLAMATION PLAN, WILL <br />BEGIN AND WILL BE COMPLETED DURING THE FIRST NORMAL CONSTRUCTION SEASON <br />FOLLOWING THE DIVISION'S APPROVAL OF THE RENEWAL OF THE PERMIT. <br />
