Box 241 <br />Gateway, Colorado 81522 <br />Dear Mr. Simpson: <br />On April 17, 1992, we sent correspondence to you requesting that you notify ue <br />of your future intentions for conducting exploration, mining and/or <br />reclamation on the Bear #1-#3 claims. We did not receive a response from you <br />in conjunction with this correspondence. <br />On June 25, 1993, Bob Kershaw of my staff conducted an inspection of your <br />operations area (T. 43 N., R. 18 W., Section 10: SE1~SW}, NMPM, San Miguel <br />County, Colorado). No recent activity in the project area was noted. The <br />only activity that has taken place within the plan of operations area since <br />the original activity conducted the first year after plan approval was in 1990 <br />when you dug approximately ten (10) exploration pits at various locations <br />throughout the project area. <br />The Surface Management Regulations at 43 CFR 3809.3-7 states, in part, that <br />"All operators may be required, after an extended period of non-operation for <br />other than seasonal operations, to remove all structures, equipment and other <br />facilities and reclaim the site of operations....". Our inspections have <br />revealed that no substantial activity has taken place within the project area <br />over the years since the plan of operations was approved. <br />In light of the above circumstances and pursuant <br />above, we are requesting that the structures and <br />site and reclamation of the area be accomplished <br />1993.
